Wondering how to choose an attorney? Here are a few things to consider:

Experience Makes a Difference

Just because an attorney says they practice bankruptcy law, that does not mean they have a thorough understanding of bankruptcy laws. They may have handled a few cases. Experience matters. I have seen the effect of inexperience in bankruptcy court. A mistake by an inexperienced or careless attorney can make the difference between keeping an asset or losing it to your creditors. Neglecting to include a debt into the bankruptcy filing can mean you are still responsible for repayment of that debt. Even less serious errors can result in additional costs to you through additional fees, rework and corrections, and delays. In the worst case scenario, a mistake could mean that your bankruptcy is not approved by the court.

Who Is Really Handling Your Bankruptcy Case?

Some law firms handle so many bankruptcy cases at once that they rely on paralegals to handle many of the details of a bankruptcy filing. This can create problems. Paralegals do not have the education and training of a bankruptcy attorney. This can mean that errors are introduced into the paperwork. It can also mean that the lawyer is not as thoroughly informed of the details of your case when they go before the bankruptcy trustee.
